This Privacy Policy (“Policy”) explains how Orange County Music and Dance Inc collects, uses, stores, and discloses personal information about our customers, prospective customers, and visitors to our website at www.ocmusicdance.org.  It also details how you can reach us with privacy-related inquiries and  your rights and choices as a data subject, including the right to object to certain uses of your Personal Data. We encourage you to read it carefully.

We collect personal information that you voluntarily provide to us, for example, through a web form, during registration, while applying for financial assistance, while scheduling a lesson, class or event, while setting up an account with us, when you contact us for customer support, or at checkout. Information may also be obtained when you express an interest in obtaining information about us or our products and services, when you participate in activities, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us, the choices you make, and the products and features you use. The personal information we collect may include first and last name, mailing address, email address, phone number, and date of birth/age.

Sensitive Information.  When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information: race/ethnic origin and income/tax information.

Payment Data. We may collect data necessary to process your payment if you make purchases, such as a credit card number, and the security code associated with your credit card. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

We automatically collect certain information when you visit, use, or navigate our website. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, date and time of your visit, browser and operating system information, device name, country, location, language preferences, referring website address, and other information about how you interact with the website, including pages and files viewed, searches, and other actions you take such as which features you use.  This information is primarily needed to maintain the security and operation of our services, and for our internal analytics and reporting purposes.

Like many businesses, we also access or store information through cookies and similar technologies (like web beacons and pixels). Our email campaigns may also use tracking technologies such as web beacons, pixels and other similar technologies to automatically collect certain information such as your IP address, browser type and version, and email engagement statistics.

Information collected from other sources

If you interact with us on a social media platform using your social media account (e.g., Facebook, Instagram, or TikTok), we receive personal information about you such as your name, email address, and gender. Any personal information that we collect from your social media account depends on your social media account’s privacy settings.

2. HOW DO WE PROCESS YOUR INFORMATION?

We process your information to provide, improve, and administer our products and services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent. We process your information only when we have a valid legal reason to do so. Examples of ways we process your information include:

  • To facilitate account creation and authentication and otherwise manage user accounts. 

  • To deliver and facilitate delivery of products and services to the user. 

  • To respond to user inquiries/offer support to users. 

  • To send administrative information to you.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. They also commit to protect the data they hold on our behalf and to retain it for the period we instruct. No personal information, including phone/mobile information, will be shared with third parties or affiliates for marketing or promotional purposes. 

The categories of third parties we may share personal information with include data analytics services, data storage service providers, finance & accounting tools, payment processors, performance monitoring tools, sales & marketing tools, social networks, user account registration & authentication services and website hosting service providers. All categories above exclude text messaging originator opt-in data and consent, this information will not be shared with any third parties.

We also may share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.

  • Other Users. When you share personal information [(for example, by posting comments, contributions, or other content to our product/services)] or otherwise interact with public areas of our products/services, such personal information may be viewed by all users and may be publicly made available outside our products/services in perpetuity. If you interact with other users of our products/ services and register for our services through a social network (such as Facebook), your contacts on the social network will see your name, profile photo, and descriptions of your activity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our services, and view your profile.

  • Legal Reasons. If necessary to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights or the rights of third parties, or to protect the safety or security of any person or entity. 

3. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

4. HOW CAN YOU WITHDRAW CONSENT/OPT OUT?

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below or updating your preferences.

However, please note that this will not affect the lawfulness of the processing before its withdrawal, nor when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of email and text message communications: You can unsubscribe from email communications at any time by clicking on the unsubscribe link in the emails that we send.  You will then be removed from our emailing list. Please Note: by opting out of emails we will not be able to email you important information regarding products and services you are signed up for with our school.

You can stop receiving text messages from us by replying “STOP” or “UNSUBSCRIBE” to the SMS messages that we send. You will then be removed from our texting list. Please Note: by opting out of SMS texts we will not be able to text you important information regarding products and services you are signed up for with our school.

We may update this Privacy Policy at any time. We encourage you to review this Privacy Policy frequently to be informed of how we are protecting your information.
